Terms of service
These terms set out the contract between Dental Bench (a trading style of Toolsmith Ltd) and anyone who buys from us. Buying through dentalbench.co.uk means accepting these terms. They sit alongside the separate Returns, Shipping, Privacy, and Compliance pages.
1. Who we are
Toolsmith Ltd (trading as Dental Bench), a private limited company registered in England and Wales (company number 16520777) at 39 Heather Road, Small Heath, Birmingham B10 9TE. VAT number GB497504454. ICO data-protection registration ZC147961.

"You" means the customer placing an order. "We" / "us" means Toolsmith Ltd. "Goods" means the dental instruments or other products you order.
2. How a contract is formed
The order process is:
- You add items to your basket and submit them for purchase at checkout.
- We send you an automated order acknowledgement by email. This is not yet an acceptance — only confirmation we received your order.
- We send a separate dispatch confirmation when the goods leave our warehouse. The contract is formed at this point.
We may decline an order before dispatch confirmation if:
- The product is out of stock and we can't restock within a reasonable time.
- A pricing or description error is detected (we'll tell you and offer the correct price or full refund).
- Trade-account verification fails for orders placed under trade pricing.
- UK export controls or destination restrictions prevent shipment.
- Payment authorisation is refused.
If we decline, we refund anything you've already paid in full within 7 working days.
3. Price & payment
- All prices are in GBP (£).
- Retail prices on the storefront are VAT-inclusive (at 20% UK standard rate). Trade-account prices are quoted ex-VAT.
- Delivery charges are additional and shown at checkout before you commit.
- We accept Visa, Mastercard, American Express, Apple Pay, Google Pay, and Shop Pay via Shopify Payments. PayPal where enabled.
- Payment is taken at order confirmation. For trade accounts on credit terms, payment is per the account agreement.
- Goods remain ours until paid for in full (see Title & risk below).
4. Delivery
Our shipping terms, costs, and timelines are set out in full on the Shipping page. The summary:
- Same-day dispatch on orders placed before 14:00 UK time, Mon–Fri.
- UK delivery typically 1–3 working days; international 3–14 days depending on destination.
- Risk passes to you on delivery (not dispatch) — see next section.
5. Title & risk
Title in the goods does not pass to you until we have received payment in full (cleared funds). Risk passes to you on delivery — i.e. once the carrier hands the parcel to you or your authorised representative.
If your package is damaged in transit, please follow the procedure on the Shipping page within 24 hours of receipt. We deal with the courier on your behalf.
6. Warranty & compliance
We sell genuine instruments manufactured by PIK PAK Industries (Sialkot, Pakistan) under an ISO 13485:2016 medical-devices quality management system. Every Class I instrument we sell is CE-marked under EU MDR 2017/745 via IBC Sweden's EU Authorised Representative mandate (EUDAMED SRN PK-MF-000033302). Full chain documented on the Compliance page.
We warrant that:
- Goods will be as described on the product page at the time of order.
- Goods will be of satisfactory quality (section 9, Consumer Rights Act 2015).
- Goods will be fit for the purpose described or any specific purpose you told us about before ordering (section 10, Consumer Rights Act 2015).
- The CE marking and regulatory documentation we cite is genuine and current.
Instruments are supplied non-sterile. Sterilisation by autoclave or equivalent before clinical use is the end-user's responsibility per the manufacturer's IFU.
7. Limitation of liability
We don't try to exclude or limit liability where it would be unlawful or unfair to do so. Specifically, nothing here limits or excludes:
- Liability for death or personal injury caused by our negligence.
- Liability for fraud or fraudulent misrepresentation.
- Your statutory rights under the Consumer Rights Act 2015 or the Consumer Protection from Unfair Trading Regulations 2008.
- Liability under section 2(3) of the Consumer Protection Act 1987 for defective products.
Subject to the above, our total liability for any one order (whether in contract, tort, breach of statutory duty or otherwise) is capped at the amount paid for that order. We are not liable for indirect, consequential, or loss-of-profits losses, or for losses that were not reasonably foreseeable at the time the contract was formed.
The instruments we sell are professional medical devices. We rely on you (or the clinician using them) to apply appropriate clinical judgement, sterilisation, and infection-control practice. We can't be liable for clinical outcomes — those are determined by the practitioner, not the instrument supplier.
8. Intellectual property
The Dental Bench brand, logo, product photography, web design, and editorial copy on dentalbench.co.uk are owned by Toolsmith Ltd or licensed to us. You may not reproduce, redistribute, or commercially exploit them without our written permission.
The parent mark TOOLSMITH LTD EMPOWER YOUR WORKBENCH (figurative) is the subject of UK Trade Mark application UK00004375341, Class 8, accepted by the UK Intellectual Property Office on 7 May 2026 and currently within the statutory opposition window. Until registration completes the mark is properly cited with the ™ symbol; the ® symbol will apply only once the registration certificate is issued, in line with section 95 of the Trade Marks Act 1994. Buying our goods doesn't transfer any IP rights — only the physical goods themselves.
9. Data protection
How we handle your personal data is set out in our Privacy notice. In summary: we collect only what we need, use it only for the purposes stated, never sell it, and respect your rights under UK GDPR.
10. Governing law & dispute resolution
These terms and any dispute arising under them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers (not businesses) resident in another part of the UK may bring proceedings in their local courts.
Before going to court, please contact us — most issues resolve quickly by email or phone. UK consumers also have access to alternative dispute resolution via the Online Dispute Resolution platform at ec.europa.eu/consumers/odr (still operational for UK-EU disputes post-Brexit) and to UK ADR-approved schemes via gov.uk/consumer-protection-rights.
11. Changes to these terms
We may update these terms from time to time to reflect changes in our practices or in the law. The "Last updated" date at the top always shows the most recent revision. Orders placed before a change are governed by the terms in force at the time of the order.
Significant changes will be notified via email to account holders and flagged on the homepage.
